1. Introduction
These Terms & Conditions (“Terms”) govern your use of the mokacigars.com website (“Site”) and any purchases you make from MokaCigar (“we”, “us”, “our”). By accessing the Site or placing an order you agree to be bound by these Terms in full. If you do not agree, please do not use the Site.
2. Age Restriction & Eligibility
You must be at least 18 years of age to purchase tobacco products in the United Kingdom. By placing an order you confirm that:
- You are 18 years of age or older.
- You are purchasing from a jurisdiction where it is lawful to do so.
- You are not purchasing on behalf of a minor.
We reserve the right to request proof of age at any stage of the order or delivery process. Orders may be cancelled and refunded if age cannot be satisfactorily verified.
3. Account Registration
You may browse the Site without creating an account. If you choose to register you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorised access.
4. Products & Descriptions
We make every effort to ensure product descriptions, images, and specifications are accurate. However, natural products such as cigars may exhibit slight variations in colour, texture, and flavour between batches. All images are illustrative and should be treated as a guide only.
We make no medical or health claims regarding any product. We reserve the right to withdraw any product from sale at any time without notice.
5. Pricing & Payment
All prices are displayed in British Pounds Sterling (GBP) and are inclusive of VAT at the applicable rate. We reserve the right to correct pricing errors at any time. If an error affects your order we will notify you and offer the option to proceed at the correct price or cancel for a full refund.
We accept Visa, Mastercard, and American Express. Payment is taken at the point of order placement.
6. Order Process & Contract Formation
Placing an order constitutes an offer to purchase. A contract between you and MokaCigar is formed only when we send you an order-confirmation email. We reserve the right to decline or cancel any order at our discretion, including where we suspect fraudulent activity.
7. Availability & Stock
Stock availability cannot be guaranteed. Limited-edition and vintage releases are finite in quantity. If an item becomes unavailable after you place an order we will notify you promptly and offer a suitable alternative or a full refund.
8. Cancellations & Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a 14-calendar-day cooling-off period beginning the day after you receive your goods.
Exceptions
The right to cancel does not apply to:
- Goods that have been opened or unsealed after delivery.
- Goods liable to deteriorate or expire rapidly.
- Personalised or custom-rolled products.
- Sealed gift sets or bundles that have been opened.
How to Cancel
To exercise your right to cancel, send written notice to support@mokacigar.com quoting your order number. You must return the goods within 14 days of cancellation at your own cost. We will process your refund within 14 days of receiving the returned items.
9. Faulty, Damaged & Incorrect Items
If you receive goods that are faulty, damaged, or incorrect please notify us within 48 hours of delivery by emailing support@mokacigar.com with photographs and your order number. Your statutory rights under the Consumer Rights Act 2015 are unaffected.
10. Intellectual Property
All content on the Site, including text, images, logos, graphics, and design, is the property of MokaCigar or its licensors and is protected by copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
11. Prohibited Use
You agree not to:
- Resell products purchased from MokaCigar without authorisation.
- Use the Site for any fraudulent or unlawful purpose.
- Send unsolicited communications (spam) via or referencing the Site.
- Scrape, harvest, or otherwise extract data from the Site by automated means.
- Impersonate any person or entity, or misrepresent your affiliation.
12. Limitation of Liability
To the maximum extent permitted by law, MokaCigar shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or any purchase. Our total liability in respect of any order shall not exceed the value of that order.
13. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site and their inclusion does not imply endorsement.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, strikes, or supply-chain disruption.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
